California has a guideline formula that is used to determine the proper amount of support to be paid for minor children based on each party’s income and the percentage of time that each party spends with the minor children. As with spousal support, determining what each party’s true income is can be challenging when either spouse is not earning to their full capacity or is a business owner that can hide income through creative accounting. Determination of the appropriate child time share percentage can also create issues. The payer spouse does not want to pay too much and the payee spouse does not want to receive too little. As such, it is important to have an experienced attorney who is familiar with all of the various issues that can arise in determining the proper amount of child support.
