Spousal Support

Upon separation from your spouse, one party may be required to contribute to the support of the other spouse where there is a disparity in each of their incomes and/or earning potential. The determination of the proper amount of support can become more challenging when one spouse is not earning to his or her capacity. Another challenge in determining true income arises when a spouse is a business owner which allows him or her to pay personal expenses through the business and/or hide income through creative accounting practices. The payer spouse does not want to pay too much and the payee spouse does not want to receive too little.
